General terms and conditions of sale
The orders placed by the Buyer in favour of March Forward S.L., hereinafter MF, are subject to these general conditions of sale, which are tacitly accepted with the acceptance of delivery of the materials.
MF reserves the right to accept any purchase request for the products it sells. In case of special or custom-made orders, no returns will be accepted.
Prices and Validity
All prices are net prices and do not include VAT or other taxes and are subject to change without prior notice. The validity of the prices is determined by the present price list, the previous one being cancelled.
Method of payment
For new customers, payment will be made in advance. Thereafter, according to agreed conditions. Any delay in payment will mean the supply will be stopped, and MF reserves the right to cancel the credit and the conditions agreed until that date.
Invoices not paid on their due date may be subject to a penalty of 3% per month plus a fixed cost of 25€/month for collection and claim management costs.
Delivery and Shipping
Delivery times may vary depending on the manufacturer or supplier, their availability and location.
For orders over 2.000€ net, with delivery in the peninsular area, the goods will be sent carriage paid. For orders with delivery outside the peninsular area, please consult us.
Returns
A return period of 30 calendar days from the invoice date is established for products in perfect condition, unused, with their original packaging, manuals, parts and accessories. Only returns previously requested by email to sales@en.marchforward.eu and accepted by MF will be accepted. Return shipping costs will be paid by the customer. MF will check the state of the product and in 5 working days will notify the customer the acceptance or refusal of the return, total or partial. In the case that part of the material does not arrive in perfect conditions, the corresponding part will not be refunded.
Claims for transport
In case of damage, breakage, blows, loss or theft of all or part of the goods, it is essential that, at the reception of the goods, the customer verifies that the delivery is complete and correct. In case he detects any anomaly, he must indicate it at the moment of signing the delivery note and inform MF (maximum 5 days from the reception, providing all the possible documentation, including photographs) in order to be able to make the appropriate claim to the carrier. Failure to comply with this rule will deprive the right to make a claim.
Warranty
Products received for repair must be accompanied by their purchase invoice or delivery note, which is necessary to verify the date of sale and the warranty period. For products where this is not specified, the general period of application of the guarantee will be 2 years from the invoice date.
The warranty covers the repair or total or partial replacement of a faulty equipment due to any manufacturing defect except when the fault is caused by wear and tear of the parts due to the normal use of the equipment.
In the event that the malfunction is due to improper installation or use, or to causes outside the normal use of the equipment, if it has been opened, manipulated, repaired or modified by persons outside the after-sales department, or if it is proven that it was acquired prior to the date covered by the guarantee, the equipment and its components will be automatically excluded from the benefits of the guarantee.
If, after evaluation of the product that is the subject of the complaint, it is found to be faultless:
- A charge of €30 (+VAT) will be charged to the customer for handling and transport, to which must be added the inspection and handling charge applied by the manufacturer or supplier.
- The product will be returned to the customer carriage paid.
Repairs
All repairs are guaranteed for 180 days from the date of invoice or repair delivery note. The warranty only covers the defect that caused the symptom itself, covering materials and labour. It does not cover other possible defects.
It is essential that the device is accompanied by a document explaining the problems it presents. Otherwise, MF reserves the right to revalue a charge for the necessary tests to detect the fault (even if the equipment is under warranty).
All out-of-warranty repairs will be accompanied by a quotation.
Retention of title
All products supplied by MF remain the property of the company until full payment of the goods.
Limitation of Liability
In no event shall MF be liable for:
- Direct or indirect damage or loss of profits or savings that may arise from the use of the equipment we place on the mark
- Any loss arising from business interruption.
- Loss of profits, income, any property or capital, anticipated savings or data.
- Death or personal injury resulting from negligence, fraud or any matter for which applicable law does not permit restriction or limitation of liability.
The products we market are not designed to detect intrusions and initiate an alarm. They are not burglary or crime prevention equipment. MF is not responsible for damage or loss caused by accident, theft, abuse, misuse, abnormal use, faulty installation, improper maintenance, or unforeseeable or unexpected situations.
MF’s liability in respect of any order or otherwise under these terms and conditions shall in no event exceed the price of the products as stipulated in the contracts giving rise to the claim.
The Buyer shall hold MF harmless against claims, damages, losses, costs and expenses incurred by MF as a result of any claims made against MF by third parties arising from the combination or use of the goods with any incompatible ancillary products that may be connected to the goods, or any other matter for which MF would not be liable to the Buyer under these terms and conditions.
Acceptance of the conditions
The customer declares that he/she is aware of these General Terms and Conditions of Sale and accepts them when placing his/her order.
